Lawyer Carlos Cuevas submitted the papers for Giudice and revealed to Entertainment Tonight earlier this week that Giudice has launched a malpractice and said the attorney who represented her in her bankruptcy case “is the reason that Mrs. Giudice is currently incarcerated.”
He went on to say, “As alleged in the complaint— if he had taken appropriate action as her attorney, entrusted with her welfare, she would not be incarcerated.”

He added that, “The missteps were so bad she had to plead guilty to bankruptcy fraud. Emotionally it’s a tremendous strain, because imagine going to bed at night and not being able to say to your children, ‘I love you.’”
Giudice pleaded guilty to several fraud charges, including bankruptcy fraud, last year and was sentenced to 15 months in prison. However, she’ll only serve a little less than a year as she surrendered on Jan. 5 but will be released on Dec. 23. Her husband Joe Giudice also pleaded guilty and was handed 41 months behind bars. He’ll start his sentence once Teresa is released. It is also possible that he will be deported back to Italy after serving his time.
The Real Housewives of New Jersey viewers saw how their legal trouble impacted their family on the most recent season of the show. Joe and their four daughters are also filming a new reality series that will document their life sans Teresa.
