They are hoping a judge agrees with them and tosses out the case filed by a man named Ron Newt claimed that they both stole his story and made it into the juggernaut hit that airs on Fox every Wednesday night.
Newt, who has called himself a “gangsta pimp” said that he actually shared his autobiography with Howard a few years back but Howard used it for his own success, TMZ reported recently.

Daniels has said that there is no way they stole his story because it’s way too inappropriate for primetime television; especially on one of the big four networks.
Daniels also said that Newt’s job as “manager of his sons’ teen bubble gum pop trio” has nothing on Lucious Lyon and his three sons’ Empire business.
Both Howard and Daniels want a judge to dismiss the case before it goes any further.
But that’s not the only lawsuit the show is facing. In fact, it’s only one of many; and they are not all from the every day person. Actor Sean Penn made headlines last month after he filed a $10 million lawsuit against Lee Daniels. Daniels was responding to allegations against Howard that he physically assaulted his ex-wives.
While doing so, he said Howard “ain’t done nothing different than Marlon Brando or Sean Penn, and all of a sudden he’s some demon. That’s a sign of time, of race, of where we are right now in America.”
No word on the current status of that lawsuit.
