Kim Kardashian Divorce: Kris Humphries' Lawyer Quits Day Before Court Appearance
Kris Humphries' lawyer requested on Thursday to be removed from the divorce battle involving the athlete's estranged wife Kim Kardasian, claiming "irremediable breakdown of the attorney-client relationship," according to documents obtained by TMZ.
The NBA player's divorce attorney, Marshall Waller, dropped Humphries as a client and filed paperwork asking a judge to remove him from the case one day before his scheduled Friday court appearance with Kardashian.
Waller said "irreconcilable differences" arose between him and Humphries, and that he should be allowed to leave the case.
The 27-year-old Brooklyn Nets' legal team is expected to complete the discovery phaseof the trial (obtaining evidence from opposing parties) by Friday.
Waller advised Humphries that there were no legal grounds for annulling his marriage to the reality star because no evidence indicated any fraud of the marriage. Humphries' out-of-state laywer Lee Hutton now needs another California lawyer to help in the divorce case, Us Weekly reported.
Kardashian filed for divorce on Oct. 31, 2011, just 72 days after getting married to Humphries on national television in a two-part E! special seen by over 10 million viewers. The 28-year-old basketball star responded to Kardashian's request for a divorce with an annulment based on fraud, while asking Kardashian to pay his legal costs. The trial was delayed three times because of Humphries' protests to prove his marriage was a publicity stunt.
On Feb. 5, Waller filed documents on behalf of his then client claiming Kardashian's "urgency" to resolve the issue with a divorce isn't what it seems, and that the reality star has put an unfair bias on the legal proceedings due to her surprise pregnancy.
"What is really going on here is that an 'urgency' in the form of an apparently unplanned pregnancy, something [Humphries] had nothing to do with, is perceived by [Kim] as an opportunity to gain a litigation advantage by trying to force this court to prematurely set this matter for trial,' Waller said in court documents.
In January, while promoting her reality show, Kourtney & Kim Take Miami, Kardashian stopped by Sway In The Morning talk show to discuss her on-going divorce with Humphries. Kardashian revealed that she indeed loved Humphries, but realized he "wasn't the right person" for her.
"What am I going to do? Wait years for a divorce? I would love one. It's a process," she added.
Kardashian is expecting her first child with boyfriend Kanye West this summer.
