According to court documents obtained by Entertainment Weekly, Justen Lipeles filed a complaint in the Los Angeles County Superior Court on May 29 asserting that he and other attendees experienced unwelcomed exposure to explicit content during her March 7 performance at the Kia Forum in Los Angeles.

Accusing the 65-year-old pop icon and tour organizers, Lipeles has leveled a series of charges in his filing, including negligent misrepresentation, intentional infliction of emotional distress, breach of written contract, and false advertising.

His claims center around the purported delay in Madonna's performance, alleging that the concert, slated to commence at 8:30 p.m., did not kick off until 10 p.m.

Furthermore, Lipeles claimed that the audience endured unexpected and explicit content, including scenes of "p***ography without warning," featuring "topless women on stage engaging in simulated sex acts." He also alleges adverse health effects from the stifling conditions after Madonna purportedly deactivated the air conditioning during the event, exacerbating the discomfort of the attendees. Additionally, Lipeles contends that Madonna resorted to lip-syncing during portions of her performance, contrary to assurances of a live show.

"Forcing consumers to wait hours in hot, uncomfortable arenas and subjecting them to p***ography without warning is demonstrative of Madonna's flippant disrespect for her fans," the complaint stated, as reported by Entertainment Weekly.

The singer's legal team filed a motion to dismiss the lawsuit last month, writing that no reasonable concertgoer would "expect the headline act at a major arena concert to take the stage at the ticketed event time."
