Katie Holmes reportedly rented an apartment in New York City to move in with her daughter Suri "weeks before" filing for divorce Thursday, according to Us Magazine.

The actress filed documents in New York City citing "irreconcilable differences" and seeking sole legal custody of Suri.

Holmes' apartment is reportedly a suite located near Union Square on 114 East 13th Street at the 114 American Felt Building.

The site Hollywoodlife.com reports that there were several paparazzi scattered outside the building on Friday trying to snap a picture of the actress but they were not sure if she had left town.

“There are several paparazzi scattered outside her apartment building [near Union Square],” a source told the site. “[Katie and Tom's] apartment seems to be the penthouse of the building with a balcony facing east. She comes out onto the balcony often, but there is not a good view of it from the street.”

The ex-couple has a $15 million house in New York City's Greenwich Village on 42 West 12 Street which they reportedly purchased in 2009. The house is a five storey residence with 5 bedrooms, a garden, terraces and a penthouse, according to a floor plan published on Starcasm.net.

Tom Cruise is currently in Iceland filming his new sci-fi flick "Oblivion."

The 49-year-old actor was spotted flying out Reykjavik airport in a private helicopter on Saturday.

In the divorce papers, Holmes is also asking for a division of property although they have a pre-nuptial agreement based on California law.

Under the prenup terms, for each year the couple stay married, Holmes collects $3 million to a maximum of $33 million after 11 years as well as their home in California, according to the Daily Mail.

If their marriage had lasted more than 11 years, Holmes would have got half of Cruise fortune estimated at $250 million.
