Katie Holmes and Tom Cruise are trying to reach a settlement nearly 10 days after the actress filed for divorce, according to a report Saturday.

Holmes' lawyers and Cruise's lawyers have been working to negotiate an agreement between the two actors to avoid a public divorce battle, People magazine reports.

"Neither one of them wants this to be hashed out in public," a source told the magazine.

Holmes was seen visiting her lawyers in New York City Friday, according to several media reports.

Meanwhile, Cruise's lawyers have said the actor was "very sad" about the split.

"We are letting 'the other side' play the media until they wear everyone out and then we'll have something to say," Cruise's lawyer Bert Fields told the BBC.

There has been speculation that Cruise would be filing a counter divorce case in Los Angeles and would be seeking joint custody of Suri. But his lawyer didn't confirm the reports.

"Tactically we can't say where Tom will file a divorce case and if he'll be seeking joint custody of Suri," said Fields.

Holmes announced June 29 that she was divorcing Cruise.

"This is a personal and private matter for Katie and her family," said Holmes' attorney Jonathan Wolfe on June 29. "Katie's primary concern remains, as it always has been, her daughter's best interest."

According to gossip site TMZ.com, she filed for divorce in New York City and is seeking sole custody of their 6-year-old daughter.
