Judge Sherry Stephens had ruled to keep the press and public out of the courtroom during the first witness' testimony, which was later overturned by the Court of Appeals as reported by AZ Central in November.
Now, the retrial has resumed and USA Today reported on Monday that Arias' defense team petitioned the Arizona Supreme Court to reverse the Court of Appeals order to release the private testimony transcripts.

The site reported like most of the retrial, this discussion was carried out of earshot of the press and public.
Judge Stephens' first words on record were, "Counsel, please approach," which led to the defense and prosecution talking to her in secrecy at her bench.
Judge Stephens then called for recess. "We are at recess for five minutes," she stated and then after the recess concluded she summoned the lawyers to her chambers.
The jury was sent home once again and Judge Stephens postponed the hearing on transcript release until Thursday.
The lawyers also conducted an interview Monday afternoon, which was also done in private with a disputed potential witness referred to in court filings only as "Pseudonym" as reported by USA Today.
Judge Stephens then canceled court for Tuesday and Wednesday.
