Halle Berry Ex Gabriel Aubrey Fights Olivier Martinez, Gets Restraining Order [Injury Picture]
Halle Berry's ex-boyfriend Gabriel Aubry obtained an order of protection Monday after providing incriminating statements and shocking pictures of injuries he sustained from a Thanksgiving brawl with the actress' fiance Olivier Martinez.
The Candian model was granted the restraining order after divulging in a written statement that Martinez, 46, is the "bad guy," according to court documents obtained by New York Post. Aubry, 36, provided a photo of his black-eye and badly bruised face with a written statement to a Los Angeles court - and won an emergency restraining order on Monday, Nov. 26.
Aubry claimed that when he went to drop of his daughter Nahla at Berry's home in Hollywood Hills, Martinez stepped outside and said to him in French, "We need to talk."
"I went to close my car door so I could to talk to him," Aubrey wrote. "All of sudden, [he] jumped on the side of my body and punched me such that he had taken me down [to] the ground. He continued to punch me at least two or three times . . . kicked me in the ribs with his knee or foot and . . . took my head in his hands and slammed it to the concrete driveway."
Aubry added that Martinez threatened to kill him after the assault.
"When you see the [custody] judge, you're going to tell him you're going to Paris or I'm going to kill you,'' the actor allegedly said. "You're going to Paris, you're going to get your $20 grand a month in child support. I'm not just some f--king actor. You don't know me."
Matinez was allegedly referring to the recent court verdict that prohibits Berry from moving to France, where Martinez is a citizen, with her daughter Nahla.
Martinez then demanded that the Quebec native lie to authorities; "We called the cops!'' Martinez allegedly said, "You're going to tell them that you're the one who attacked me or I'm going to kill you!"
Martinez received an order of protection against Aubry immediately after the attack.
Aubrey claimed that the fued intitially began the day before the attack. When he met up with Berry, 46, and Martinez at their daughter's school, the "Unfaithful" actor allegedly whispered to him in French, "I wish I could beat the s**t out of you right now. You're lucky we're in a school right now. We're going to take Nahla right now and you're not going to follow us."
Berry's lawyers will be in court trying to extend their temporary order of protection, which ends on Tuesday, Nov. 27.
Aubry began dating the Oscar-winner in 2005 after they met at a Versace photo shoot they appeared in together. Berry gave birth to Nahla Ariela Aubry on March 16, 2008. The former couple split in 2010.
Berry began dating Martinez later in 2010 and they announced their engagement last March.
Since their split, Aubry and Berry have been involved in a highly-publicized custody battle, where Berry requested permission to move her daughter to France. A judge denied the request two weeks ago.
