The jury had the duty of choosing between the death sentence or life in prison. The defense attempted to argue that Holmes "was in the throes of a psychotic episode" at the time of the shooting, according to the Washington Post, and the jury could not reach a unanimous final sentencing verdict on 12 counts of murder in the first degree. Therefore, the court will impose a sentence of life imprisonment without the possibility of parole.
