Apollo Nida feels the pressure as he is just days away from being handed what could be a 30 year sentence for fraud; now he begs for a lower the maximum time behind bars.

Nida, who is married to The Real Housewives of Atlanta star Phaedra Parks and scheduled to be sentenced Tuesday, has asked a judge to reduce his criminal history category so he can receive a lesser maximum sentence, Radar Online reported Sunday.

Nida's lawyers asked the Atlanta district court to switch up his status from Criminal History Category V to Criminal History Category IV.

His legal team wrote in documents obtained by the site, "A criminal history category of V substantially overstates the the seriousness of Mr. Nida's criminal past, thus warranting a departure from the Guidelines range."

The document goes on to reference Nida's past as a personal trainer whose probation was annulled three times as well as driving under the influence and giving police a fake name. Nida committed each of these crimes before he was 24 years old. His lawyers say this is not the same level of crimes and violence and drug-related, so it should not be treated as such.

"Mr. Nida's lengthy but early small-time criminal history is simply not in the same league as the 'violent offenders, drug kingpins and perpetrators of far more serious offenses that Criminal History Category V was designed to address."

Nida pleaded guilty to several counts of fraud including identity theft and wire fraud. He set up phony businesses and bank accounts to deposit stolen money from U.S. Treasury.
