Tracy Morgan fought back after Walmart blamed him for his injuries in his tragic accident. Now, a Chicago lawyer is saying that this action is not unusual in cases like these.

"It's not unusual for questions about seatbelt use to arise during such proceedings," said Gregory F. Coplan, a personal injury lawyer in Chicago to Insurance News. "This is one of the reasons why accidents involving serious injuries and fatalities can become complicated. Big corporations typically have teams of lawyers working to protect their interests. People who were injured or lost loved ones in these accidents can quickly become overwhelmed and feel powerless."
Morgan's own lawyer Benedict Morelli said the 30 Rock actor was "struggling" after the accident. Morelli revealed to ABC News that Morgan is still in a wheelchair and is still struggling along. "Also Tracy is fighting so hard to recover and when Walmart puts out a statement like this...it makes all of the families of my clients very upset."

"All of my clients have had traumatic brain injuries and they are all extremely injured," Morelli said. "It is actually an embarrassment that they are putting in an answer like this, blaming the victims. It is not appropriate."
Walmart had issued a statement previously that blamed Morgan for not wearing a seatbelt. "By failing to exercise ordinary care in making use of available seatbelts, upon information and belief, plaintiffs acted unreasonably and in disregard of plaintiffs' own best interests," Walmart's 28-page response read. "Accordingly, all or a portion of the injuries could have been diminished or minimized by the exercise of reasonable conduct using the available seat belts."
