Sofia Vergara is about to have the nightmare of her life. A judge has allowed her ex-fiance Nick Loeb to sue for custody of their embryos, despite her plea to keep them frozen indefinitely.

According to People Magazine on Saturday, Loeb originally sued the Hollywood actress to keep her from destroying the embryos they created while they were still together and this new lawsuit would allow him to control what happens to them. The ex-couple broke up earlier last year and Vergara is now in a relationship with actor Joe Manganiello, who she's been engaged to since Christmas.

Speaking to Howard Stern, Vergara hinted that Loeb might have some sort of agenda against her and that she also wants to resolve this as peacefully as possible.

Sofia Vergara Responds To Nick Loeb's Allegations That She Wants To Destroy Her Embryos

She said, "It makes no sense. A child needs a loving relationship of parents that get along, that don't hate each other...I don't hate him but he obviously has a problem with me! A kid needs parents. I wouldn't imagine anyone saying that it's sane to bring to the world kids that are already set up, everything wrong for them. It would be so selfish."

When asked about Loeb's legal standing against her, Vergara shrugged it off, saying that he should have considered all the ramifications while they were still together.

She added, "There is law. You signed papers, legal papers, and if it was so serious for him, this issue - which I totally respect it is serious for someone - then you should have taken it more serious at the time like I did...there is a contract."
