Apple Throws A Tantrum Over Court Order With Samsung
Apple Inc. must reveal information about their patent deal with HTC to Samsung Electronics Co. as part of an ongoing patent infringement lawsuit between the two tech giants, a judge ordered on Thursday.
Samsung requested to see the patent agreement between HTC and Apple in order to potentially help its defense in Apple's claim that Samsung infringed on eight of its patents, according to Yahoo. The tech giant's crusade might result in some of Samsung's biggest products being taken off store shelves. Samsung denied infringement and filled its own complaint - claiming that Apple's iPhone and iPad infringed eight of its patents.
Samsung wants to know if Apple licensed any of the patents that it was found to have infringed. If that be the case, Apple's request that infringing Samsung products be removed from the shelves might not hold much value any longer, especially because Apple was happy to "forego exclusivity in exchange for money" and it is already living off a "hefty $1.049 billion verdict" from an August lawsuit against Samsung, according to The Verge.
The companies will discuss the injunction on Dec. 6.
On Friday, Apple asked a federal court to add six more Samsung items to its lawsuit. The new Items that Apple are fighting to be taken off the shelves for patent infringement include Samsung's Galaxy S III running the latest Android software, Galaxy Note 2, Galaxy Tab 8.9 Wifi, Galaxy Tab 2 10.1, Rugby Pro and the Galaxy S III Mini.
An earlier lawsuit by Apple relating to different patents ended in a $1.05 billion jury verdict against Samsung on Aug. 24, according to Reuters. The second, and current, lawsuit against Samsung was filed in February.
In October, Apple lost a court battle to Samsung in the U.K. and posted a "sorry-note" on the Internet saying, "Galaxy Tab 10.1, Tab 8.9 and Tab 7.7 do not infringe Apple's registered design No. 0000181607-0001," and quoting the U.K. judge's decision.
