Word is that lawyers who represented Giudice’s creditors want her Chapter 7 bankruptcy case reopened.

Apparently Giudice is suing her bankruptcy attorney James Kridel for bankruptcy malpractice, after she and her husband Joe Giuduice were accused, pleaded guilty to and served time in jail) for bankruptcy fraud. They are hoping that if Teresa does win her case, they can get some of the money she receives, Radar Online reported Monday.

Bankruptcy Trustee John W. Sywilok filed the case Friday and said in documents that if Teresa wins any money from this, it should be considered assets that will be included in the bankruptcy case that was closed on Sept. 29, 2014.

“The Chapter 7 Trustee will have to determine the value of this asset and whether its liquidation will realize a meaningful dividend to the unsecured creditors of this case,” Sywilok wrote in the documents.

It also points out that when the case was closed, “there were insufficient funds in the Estate to make any distribution to unsecured creditors.”
Sywilok must have had a compelling argument because the case has been reopened and Carlos Cuevos, the lawyer who is now representing Teresa in her case against Kridel, doesn’t seem too happy to have to deal with it.

“Apparently [Sywilok] is seeking to take control of the litigation, so we need to respond to that. We are fighting [the trustee’s motion]. Teresa is very tough woman and we’re going to contest it. Our contention is that we have alleged that the vast bulk of the malpractice occurred subsequent to the filing of Mrs. Giudice’s bankrupty case, and therefore it is not property of the estate.”

Well, Cuevas has been ordered to respond to the case by May 16. Teresa is also set for a hearing with Sywilok on May 24. This could get interesting. Meanwhile, Joe is serving his 41-month sentence at Fort Dixon in New Jersey. He turned himself in on March 23. Teresa was released on Dec. 23 and ended her house arrest in February.
